Justice Bryan Mahoney ordered Tony Braile, Brad McNish and Bryan Morton to serve various periods behind bars, with Morton getting the harshest punishment — 30 months in a federal prison. McNish was sentenced by the Court of Queen’s Bench judge to six months, while Braile, who took part extensively in the harassment of former Calgary woman Akele Taylor but later became a whistleblower in the case, was handed a three-month term to be served on weekends. ”When police officers sell their services for personal profit, the rule of law breaks down,” Mahoney said in his lengthy sentencing decision. ”Individuals are denied equal access and equal protection of the law (when that occurs).” Mahoney was particularly critical of Morton, who he said seemed to relish stalking Taylor at the behest of her ex-boyfriend, wealthy businessman Ken Carter, with whom she was embroiled in a child-custody battle at the time. ”His conduct had the effect of showing it is possible to buy a police officer,” the judge said. ”Trial evidence verified that Mr. Morton showed a very cavalier attitude toward the harassment of Ms. Taylor. He seemed to enjoy it.” Mahoney said the sentence had to be greater than the community-based punishment proposed by Morton’s lawyer, Jim Lutz. ”The sentence must attempt to counter the public cynicism that may arise when offenders like Mr. Morton act as if corruption laws do not apply to them.” Mahoney said all three officers were motivated by greed, even though McNish told psychologist Dr. Patrick Baillie he was acting out of a sense of misguided loyalty to former Calgary Police Service member Steve Walton, who orchestrated the surveillance of Taylor.
